Agreement to Terms

By accessing or using BidScout (operated by ABN 19 598 285 513), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our service.

Description of Service

BidScout provides AI-powered tender intelligence services, including aggregation of publicly available government tender data, AI analysis of tender documents, and related features. Our data is sourced from AusTender, the Australian Government's official procurement platform.

Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Subscriptions and Payments

Subscription Services: Our subscription plans are billed monthly. You will be charged at the beginning of each billing period.

One-Time Purchases: AI Bid Accelerators are one-time purchases for specific tenders.

Cancellation: You may cancel your subscription at any time. Access will continue until the end of your current billing period.

Refunds: Subscription fees are generally non-refundable. For premium reports, contact us within 7 days if you're not satisfied and we'll work with you to resolve the issue.

Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Scrape, copy, or redistribute our content without permission
  • Use automated tools to access the service (except as permitted)
  • Resell or redistribute our analysis without authorization

Intellectual Property

The BidScout platform, including our AI analysis, user interface, and original content, is protected by copyright and other intellectual property laws. Tender data sourced from AusTender is publicly available government information. Our analysis and presentation of this data is proprietary.

Disclaimer of Warranties

BidScout is provided "as is" without warranties of any kind. While we strive for accuracy, we do not guarantee that:

  • Our data is complete, accurate, or up-to-date at all times
  • Our AI analysis will identify all relevant information
  • The service will be uninterrupted or error-free

Important: BidScout provides intelligence to assist your tender decisions, but should not be the sole basis for any bid. Always verify critical information directly with the issuing agency and review original tender documents.

Limitation of Liability

To the maximum extent permitted by Australian law, BidScout shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Changes to Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We'll provide reasonable notice of significant changes where possible. Continued use of the service after changes constitutes acceptance of those changes.

Governing Law

These terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes shall be resolved in the courts of the Australian Capital Territory.
